​Bergenstråhle & Partners wins patent case at the Patent and Market Court of Appeal

Bergenstråhle & Partners’ litigation team, headed by Jarmo Kääriäinen, won the dispute regarding an alleged patent infringement between SEM AB and Walbro Engine Management LLC. The judgement was handed down in Patent and Market Court of Appeal on Friday 21 April.

“The case involved some interesting questions concerning the validity of the patent, and from my experience it is quite rare that a patent, in a litigation process, is invalid based on lack of novelty. We were quite surprised that the case went all the way to the Court of Appeal, especially since both the District Court and the Patent and Market Court of Appeal, unhesitatingly found the patent invalid based on lack of novelty,” says Jarmo Kääriänen, Partner & Head of Litigation, Bergenstråhle & Partners
