Neighbourhood nuisance evicted in Bury East

A tenant has been evicted from his home after being found guilty of causing a nuisance and annoyance to his neighbours.

Michael Chadwick, 29, of 3 Bealey Drive, Bury East, was evicted from his property on 13 December 2012 after Bury Metropolitan Council was granted a warrant by Bury County Court.

In order for Six Town Housing to obtain the possession order, residents documented numerous incidents of loud music, shouting, fighting and screaming in and around the property.

Despite Mr Chadwick receiving official tenancy warnings, residents continued to supply evidence of the ongoing anti social behaviour including fighting, arguing and screaming, in and around the property.  

On the strength of evidence obtained by officers, the police and residents, Six Town Housing applied to the courts for possession of the property in September 2012. Bury County Court granted BMBC possession of his home on 26 October 2012.

In November 2012, Bury County Court received Mr Chadwick's application to suspend the warrant of eviction and a hearing was scheduled for 6 December 2012 but on 6 December 2012, a judge upheld the original decision and ordered Mr Chadwick to vacate the property forthwith.

David Fettis, 68, main complainant against Mr Chadwick said “This is terrific news. I wish to stay a big thank you for all the support and advice I received throughout the case from the Six Town Housing ASB team. Nobody likes to see anyone evicted from their home, but this person was given every opportunity to amend his ways but chose to ignore it. I can now get my life back on track”.
