Fined for not clearing up his dog’s mess

A Tottington dog owner has been prosecuted by Bury Council for failing to clean up after his pet on two occasions.

David Physick (aged 44) of Sycamore Road was fined by Bury magistrates after he failed to pay two Fixed Penalty Notices he had been issued for the offences.

The court was told that on 15 April 2014 a council dog warden saw a Yorkshire terrier being let out of the front door of Physick’s house and fouling the pavement. A second incident, again witnessed by a dog warden, took place on 29 May 2014 when a dog from the same address was let out and fouled a nearby grass verge.

Physick was given a £50 fixed penalty notice on both occasions for not cleaning up his dog’s mess, but he did not pay them. The case went to Bury Magistrates Court on 4 November 2014 where he was found guilty in his absence of two dog fouling offences. He was fined £400 (£200 for each offence) and ordered to pay full costs of £478 and a £20 victim surcharge.

The court also heard that Physick had previously been fined by Bury magistrates in March 2013 for not paying a fixed penalty notice issued for not cleaning up after his dog. 

Councillor Sandra Walmsley, cabinet member for resource and regulation, said: “This prosecution sends a clear message that we will not tolerate dog fouling in this borough or the anti-social behaviour of a small number of dog owners that are ruining the environment for everyone else.
