Orca Digital is fit and ready for the new Premium Rate Code of Practice

Anticipating the premium rate regulators new Code of Practice, Orca Digital, the leading provider of live and interactive services to the entertainment industry, has developed and installed the business processes required from September 1st 2011.

Under the new Code the party who controls an activity is accountable to PhonepayPlus for compliance with the 6 consumer outcomes in the Code. If a company controls the advertising, then it is accountable for compliance; similarly a company controlling a premium rate application platform is accountable for the technical design and conduct of the service. A Premium Rate provider contracting with one of these parties is required to conduct due diligence and risk control before and during a business relationship.

Orca Digital now operates under the new standards. It has communicated with all customers to explain the new rules and obligations. Its contract terms clearly identify where Orca is taking controlling responsibility, and where the client is accountable. Behind the scenes it is already running due diligence before it contracts with a client, with a risk control plan for every client’s new service, to ensure that the services remain compliant.
