Claim vs straightforward relinquishment

With all the success in timeshare compensation claims over the last few years, it is easy to forget that some owners just want to escape the burden of their maintenance fees. Many of these people would rather a quick, easy relinquishment than wait the extra time for compensation.

Compensation success

Since 2016, timeshare companies have been sanctioned wholesale by the courts, with punitive financial penalties awarded over deliberate disregard for protective consumer laws.

Leading claims company ECC, working together with expert firm of timeshare lawyers M1 Legal, have a current legal success rate of 98.6% on timeshare claim cases. The average compensation award is around £20,000.

The wait can be around 18 months for a claim to go through the Spanish Courts. For some people, getting free from the contract more swiftly is worth missing out on the compensation.

    Straightforward relinquishment

    The timeshare industry spends a lot of money on 'anti-claims firm' propaganda. To be blunt: they would rather you didn't sue them over your illegal contract, and they will do anything they can to put doubt in your mind about doing so.

    There are unfortunately scam firms offering claims services who simply want to steal your money. Timeshare companies capitalise on this and pay proxy websites to maintain a position that ALL claims companies are fraudulent.

    If they can muddy the water enough, many victims will not feel confident to claim their rightful compensation.

    It is possible to research and tell genuine from dishonest firms, but for a significant amount of people, the uncertainty is just not worth the stress.

    Those people would rather escape quickly, easily, with the minimum amount of fuss and put their timeshare nightmare behind them.

    Just as impressive are the video reviews ECC encourage customers to leave about them on the website. Video reviews allow the viewer to see the people involved and judge the authenticity of their testimony.

    In ECC's case, the company submits the reviews to external auditing company KFP Consulting for verification. KFP are ex-UK Trading Standards officers, under the leadership of Leon Livermore, the former Chief Executive Officer for Trading Standards UK. KFP contact the clients to verify that:

    • they are genuine ECC clients
    • the review accurately reflects their experience with ECC
    • they received no incentive, financial or otherwise to give a positive review

    "Timeshare relinquishment takes an average a couple of months," confirms Andrew Cooper, CEO of European Consumer Claims (ECC). "Sometimes it is quicker, and sometimes it can take longer.

    "It always depends on the resort, and before deciding whether to go ahead you would be given approximate timescales by our experts.

    "For the majority of timeshare owners, if they act now they can be out of the membership by Christmas and avoid paying the 2023 maintenance.
